1. Who provides the service
Fragtal (“the app”, “the service”) is a project by Andrés Blanco F., an individual based in Mexico (“we”, “us”). These terms govern your use of the app and of this website.
How your personal data is handled is described in the Privacy Policy, which forms part of these terms.
2. Acceptance and age
By creating an account or using the app you accept these terms. If you disagree with any part of them, do not use the service.
You must be 18 or older to use Fragtal. By signing up you confirm that you are.
3. Your account
- Your account is personal and non-transferable. You are responsible for activity that happens in it.
- You must provide accurate information and keep your sign-in credentials protected.
- If you notice unauthorised use of your account, tell us as soon as you can.
- You can close your account whenever you like from inside the app, under Profile → Account → Delete account. Deletion is immediate and irreversible.
4. What Fragtal is and isn't
Fragtal is a personal tool for recording and understanding your fragrance collection. It is a notebook, not an oracle.
It is not medical advice. The app lets you note whether a fragrance gave you a headache or an allergic reaction, and reminds you of it. That is a record you made, not a diagnosis. If you have any reaction, consult a healthcare professional.
It is not financial advice or an appraisal. Values, averages and projections are calculated from the figures you enter yourself. They are indicative estimates, not the real market price of your bottles nor a recommendation to buy or sell.
We do not warrant that the fragrance catalogue information is complete, accurate or up to date.
5. Your content
Your photos, your notes and your data remain yours. We claim no ownership over them.
To provide the service we need a limited, technical licence: to store your content, process it — for example, cutting the bottle out of a photo — and display it back to you inside the app. That licence is free of charge, non-exclusive, exists solely to operate the service, and ends when you delete the content or your account. We do not use your photos or text to promote the app or for any other purpose without asking you first.
You are responsible for having the rights to what you upload and for it not infringing anyone else's rights.
6. Acceptable use
In using Fragtal you agree not to:
- Access or attempt to access other people's accounts or data.
- Circumvent free-plan limits, access controls or purchase mechanisms.
- Bulk-extract the catalogue or the service's content by automated means.
- Interfere with the operation of the service, overload it, or probe it for vulnerabilities without authorisation.
- Upload unlawful content, or content that infringes the rights of others.
- Use the app for illegal activities.
If you find a security flaw, please write to hello@fragtal.app before disclosing it. We will genuinely appreciate it.
7. Collector subscription
Fragtal can be used for free, with some limits — among them, how many fragrances you can store. The Collector subscription lifts those limits and unlocks additional features.
- Payment is processed by the store (App Store or Google Play) through your Apple or Google account. We do not handle your payment details.
- Price, duration and currency are shown in the app before you confirm the purchase. Applicable taxes may vary by country.
- The subscription renews automatically at the end of each period unless you cancel at least 24 hours before renewal.
- Cancellation is done from your Apple or Google account settings, not from the app. Deleting the app does not cancel the subscription. When you cancel you keep access until the period you already paid for ends.
- Refunds are handled by the store under its own terms. If you think something went wrong, write to us and we will help where we can, but the final decision is Apple's or Google's.
- If you stop being a subscriber, your data is not deleted: the collection you already have is kept, though paid features stop being available and you cannot keep adding above the free limit.
- We may change prices or what the plans include, with reasonable advance notice. Changes do not affect a period you have already paid for.
If you live in the European Union, your right of withdrawal and other consumer rights are exercised with the store you bought from.
8. Catalogue and trademarks
The app includes a reference catalogue of fragrance and brand names, purely for informational and descriptive purposes, so you can identify your own bottles.
Trademarks, trade names and product images belong to their respective owners. Fragtal is not affiliated with, associated with, sponsored or endorsed by any of those brands, and does not represent them. If you are a rights holder and believe content should be taken down, write to us and we will review it diligently.
9. Availability and changes
We do our best to keep the service running, but we do not guarantee uninterrupted availability or freedom from errors. There may be outages due to maintenance, incidents or causes beyond our control.
We may modify, add or withdraw features. If we are going to withdraw an important feature or discontinue the service, we will give reasonable notice and an opportunity to export your data.
10. Termination
You can stop using Fragtal and delete your account at any time.
We may suspend or close an account that seriously breaches these terms, particularly section 6, or where the law requires it. Unless it is impossible or legally prohibited, we will give notice first and explain why. If we close an account on our own initiative and it is not due to a breach by you, we will refund the unused portion of the subscription pro rata.
11. Warranties and liability
The service is provided “as is”, without warranties that it will fit a particular purpose beyond what is described here.
To the fullest extent permitted by law, we are not liable for indirect damages, loss of profit or loss of data arising from the use of, or inability to use, the service. Our total liability to you is limited to the amount you have paid us in the twelve months before the event giving rise to it; if you have paid nothing, to fifty US dollars or the equivalent.
None of the above excludes or limits liability that the law does not allow to be excluded: wilful misconduct, gross negligence, harm to life or personal integrity, or any rights consumer protection law grants you on a mandatory basis.
You are responsible for your own copies. Although your data is stored on servers with backups, Fragtal is not a backup service. If your collection matters to you, keep a copy of your own as well.
12. Governing law
These terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Mexico, waiving any other jurisdiction.
If you live in the European Union, the United Kingdom or another jurisdiction whose consumer law grants you mandatory rights, this clause does not deprive you of the protection of your country's rules or of access to its courts.
13. Changes to these terms
We may update these terms. We will publish the new version on this page with its effective date, and if the change is material we will tell you inside the app or by email before it applies. If you keep using the service after that date, we take it that you accept them; if not, you can close your account.
If any clause turns out to be invalid, the rest remains in force.
